nestux 2.0Software Libre y GNU/Linux 100% Tabasqueño.

La famosa (por que creo que la he mencionado varias veces) PC de mi papa es una Pentium lll con 128MB de RAM Compaq del año del caldo y como le estoy haciendo servicio estaba buscando que distribución GNU/Linux instalarle. Estuve pensando en Vector Linux, luego en ZenWalk y derrepente me acorde de un proyecto que estaba en sus primeros tiempos llamado UbuntuLite la cual es una distribución basada en Ubuntu para máquinas con muy pocos (poquisimos) requerimientos.

Sin embargo UbuntuLite no es un proyecto directo de Ubuntu Canonical y mientras estaba descargando la imagen iso me llamo la atencion un post en la misma página oficial en donde muestran un mail que fue enviado a los desarrolladores por parte de una trabajadora de Canonical llamada “Michelle” pidiendo a los primeros que cambiaran el nombre del proyecto puesto que no es un “producto” directo de Ubuntu. La carta dice lo siguiente (original en ingles):

Hi,

Just to introduce myself, I am a member of the trademark team at Canonical. As you are no doubt aware, Canonical owns a number of trademarks and these include UBUNTU, KUBUNTU, EDUBUNTU, and XUBUNTU. The trademarks are registered in both word and logo form. This policy encompasses all marks, in word and logo form, collectively referred to as “Trademarks”.

Your Ubuntulite project has been brought to our attention:

As much we do appreciate your enthusiastic support of Ubuntu and appreciate the time and effort you have devoted to the project, we’re afraid that there are trademark issues with your project. We’ve tried to define a reasonable trademark policy that allows people to customise Ubuntu, and use the marks to promote the project, while at the same preserving the integrity of the marks.

In terms of our trademark policy you cannot use the Ubuntu, Kubuntu or Edubuntu logos in combination with other marks or logos. With your project you are using our Kubuntu logo together with your project name Ubuntulite and this is a breach of our trademark.

Your project name, Ubuntulite is also not compliant with our trademark policy. We do encourage people to make custom versions of Ubuntu, and we have established the “remix” concept and terminology to allow use of the trademark if the changes are minimal or include only software from the Ubuntu repositories. It is of course fine to host repositories and distribute the software - the issue is that you are attaching the brand, quality and assurance messages of the Ubuntu marks to something which is not Ubuntu. We wouldn’t have a problem with you naming your project Ubuntu Lite Remix for example.

Regarding the url, again, there is a trademark issue with this as in terms of our policy we do not allow the word Ubuntu to be used in a domain name or url and Ubuntulite is in breach of this.

Again,we’d like to stress that we do appreciate your enthusiasm for Ubuntu, however, the Ubuntu name and logo to refer to your own project (i.e, not Ubuntu) needs to be changed.

En pocas palabras esto quiere decir lo siguiente: Canonical (concretamente el equipo de marcas registradas) apoya el entusiasmo de los desarrolladores por dar a conocer linux y por basarse en Ubuntu para su distribución pero es necesario que cambien el nombre al proyecto (osea a la distribución UbuntuLite) puesto que tanto los nombres Ubuntu (Kubuntu, Edubuntu, Xubuntu, etc) como los logos son marcas registradas por canonical. Obviamente al tener derechos sobre la palabra Ubuntu y los logos Canonical puede ejercer acciones legales en contra de aquellas personas que creen proyectos con estas caracteristicas.

¿Mi opinion? esto es una estupides. Señores estamos hablando de Software Libre, yo no estoy en contra de las empresas hagan dinero a costa de GNU/Linux siempre y cuando no se vean afectadas las licencias libres. Ubuntu/Canonical estan apegadas a la licencia GPL y con eso cualquiera (como en este caso) puede tomar el código y crearse una distribución mas liviana para máquinas mas livianas.

Creo que aqui se muestra la diferencia entre la comunidad libre y las empresas que crean sistemas libres, es una pena que Ubuntu haya sacado las garras asi por sus marcas registradas cuando en si todo su código es libre a todo el mundo. Ahora, cualquiera pudo haber enviado ese correo diciendo que es un trabajador de Canonical, tambien tendriamos que esperar a ver si los desarrolladores reciben algun documento que avale el email que les fue enviado. De todas maneras de verdad espero que no haya ningun acto legan entre estos dos proyectos…por que ambos son Software Libre.
